Do pengers have to pay for taxi accidents in Thailand?

I think if that were true and a taxi driver had a run down car he's been using everyday for 5-10 years, he wants a replacement but dosen't want to spend the money, all he would have to do is wait for a sucker then run into a tree, presto-chango better car at the hands of a customer. Thai law does not state the penger is in any way responsible for an accident.
